Mega Medical – Sales Terms & Conditions

These terms apply to all purchases made through megamedical.com.au ("we", "us", "our"). By placing an order, you agree to these terms, in addition to our Privacy Policy.
1. Orders and acceptance
1.1 Placing an order through our website is an offer to purchase, not a binding contract. A contract is formed only when we confirm your order in writing (e.g. an order confirmation or dispatch email) or when the goods are dispatched, whichever happens first.
1.2 We may decline or cancel any order at our discretion — for example, where stock is unavailable, the order appears fraudulent, or a pricing error has occurred (see Section 2).
1.3 These terms, together with your order confirmation, form the entire agreement between us for that order. Any variation must be agreed in writing.
2. Pricing and price adjustments
2.1 All prices are shown in Australian dollars and include GST unless stated otherwise.
2.2 We take reasonable care to ensure prices are accurate, but errors can occur (for example, clerical errors, incorrect data from a supplier or manufacturer, or a technical fault). If an item's price is displayed incorrectly, we are not obliged to fulfil the order at that price. We will contact you to confirm the correct price before proceeding, and you may choose to cancel at no cost.
2.3 We may adjust prices from time to time to reflect changes in our costs, exchange rates, or supplier pricing. Price changes do not affect orders you have already placed and had confirmed.
2.4 Discount and promotional codes may exclude certain products (for example, bulky or heavily discounted items such as oxygen concentrators, mobility scooters, and wheelchairs). If a code is applied in error, we reserve the right to correct the order total or cancel the order.
2.5 Price Beat Guarantee
If you find an identical, new, and in-stock item advertised at a genuinely lower price by another Australian retailer, we'll beat that price by 2%. To claim, contact us with a link or screenshot of the competitor's current listing before you purchase.
This guarantee excludes:
- orders that have already been paid for;
- overseas retailers and grey-market imports;
- listings on general marketplaces (e.g. eBay, Amazon, Gumtree);
- prices only available in remote postcodes (see Section 4.5) or affected by unusual shipping costs;
- stock liquidations, clearance items, or pricing errors; and
- bulky or high-shipping-cost items where shipping cost differences make a direct comparison impractical.
We reserve the right to verify any competitor price and to decline a claim we reasonably believe is not genuine.
3. Our 30-Day Guarantee
We want you to buy with confidence, so most issues with your order are covered for 30 days from the date of delivery — separate from, and in addition to, the shorter change-of-mind window in Section 4.
3.1 Faulty, damaged or defective items
If your item arrives faulty or damaged, or develops a manufacturing defect, within 30 days of delivery, we will make it right at no cost to you. Depending on the issue, we will offer:
- troubleshooting support to resolve the issue where possible;
- a replacement part or full replacement unit; or
-
a full refund of the purchase price.
No restocking fee applies, and we will cover return shipping for approved claims under this section.
3.2 Delivery disputes and shortages
If your order arrives with items missing, wrongly picked, or visibly damaged in transit, notify us within 30 days of delivery so we can arrange a replacement, missing item, or refund as appropriate. We may ask for photos of the item and its packaging as received.
3.3 How to make a claim
Contact us within the applicable 30-day period with your order number, a description of the issue, and photos or a short video showing the fault. We may ask you to send the item back to us (or, for some products, direct to the manufacturer) for inspection before a remedy is confirmed.
4. Change of mind returns (7 days)
4.1 We accept change-of-mind returns — for example, if you've made a wrong selection or simply no longer want the item — within 7 days of the date of delivery. This is separate from, and shorter than, the 30-day guarantee in Section 3, which only covers faulty items and delivery issues.
4.2 To qualify, the item must be:
- unused and unassembled;
- in its original packaging, with all accessories, manuals and consumables included; and
- not one of the excluded items listed in Section 6.
4.3 Change-of-mind returns are subject to a 15% restocking fee and the cost of outbound shipping, both deducted from your refund. Return shipping is at your expense.
4.4 Requests to return an item for change of mind after the 7-day window, or where the item does not meet the conditions above, will not be accepted, though we may consider them at our discretion on a case-by-case basis.
5. How to request a return
Contact our team on 1300 881 824 or by email with your order number and the reason for the return.
If approved, we'll request you ship the good back to us with a copy of your original sales invoice.
Post the item back to us at: 9 Middleton Road, Cromer, NSW 2099, clearly marked with a copy of your original sales invoice.
Returns sent without an original sales invoice may be delayed or refused.
5.1 Refunds
Once your return is received and inspected, we will process your refund within 10 business days. Refunds are issued to your original payment method, or as a credit note if your account is on payment terms.
Items must arrive back with us in saleable (or, for faulty items, as-received) condition. If an item is returned damaged due to inadequate packaging or misuse, we may reduce or withhold the refund accordingly — we'll always contact you first to explain why.
5.2 Hygiene, cleaning and packaging requirements
Because we sell medical equipment, some items have extra requirements before they can be returned:
Equipment must be thoroughly cleaned and disinfected in line with the manufacturer's instructions before it is sent back — including emptying canisters, removing consumables, and wiping down all surfaces.
A completed Hygiene & Cleaning Declaration must accompany the return. Equipment returned without this declaration, or that arrives uncleaned, may incur a cleaning and decontamination fee, and in some cases may be refused.
For hygiene reasons, certain single-use or intimate-contact items (e.g. masks, mouthpieces, tubing) cannot be returned once the packaging has been opened, other than under the faulty-item guarantee in Section 3.1.
6. What isn't covered
The following are excluded from the change-of-mind return in Section 4, and, where noted, from returns generally:
- Custom-made, special-order, or made-to-order items.
- Consumables and single-use hygiene items once opened (masks, mouthpieces, filters, tubing), except where faulty.
- Schedule 4 (prescription-only) medicines, such as Penthrox, which cannot be returned once dispensed, in line with pharmacy regulations.
- Gift cards.
- Normal wear and tear, or damage caused by misuse, improper installation, or lack of maintenance.
- Items not returned in their original packaging or that have been assembled (change-of-mind returns only).
7. Product warranty (beyond the 30-day guarantee)
Most products carry a manufacturer's warranty that continues after our 30-day guarantee period ends. Warranty terms, including duration, vary by product and manufacturer.
To make a warranty claim, contact us with your proof of purchase and the product's serial number, along with photos or video of the issue. We'll help coordinate the claim with the manufacturer; final warranty decisions rest with the manufacturer, and processing times vary accordingly. Warranties do not cover consumables, accidental damage, misuse, unauthorised modification, or lack of routine maintenance.
8. Delivery and shipping
8.1 We aim to dispatch orders placed before 2pm AEST on the same business day, subject to stock availability. Orders placed after this time, and orders for bulky items requiring quality-control checks (e.g.oxygen concentrators, anaesthetic machines, resuscitation kits, custom-made items), will generally dispatch the next business day.
8.2 Delivery timeframes provided at checkout or by our team are estimates only. While we work with reputable carriers to deliver on time, we do not guarantee delivery by a specific date, and delays caused by the carrier or circumstances outside our control do not entitle you to cancel your order or withhold payment, though you remain entitled to your rights under Section 3.2 and the Australian Consumer Law.
8.3 For all orders our carriers may leave your parcel without a signature (Authority to Leave) unless you tell us otherwise at checkout. Once a parcel is marked as delivered by the carrier, please check your tracking and contact us promptly if it hasn't arrived — we're happy to help chase this up with the carrier.
8.4 If a delivery attempt fails because no one was available, an incorrect address was provided, or the parcel is returned to us as unclaimed, we may pass on any re-delivery, storage, or return shipping costs charged by the carrier.
8.5 Orders to remote areas (including regional Northern Territory and Western Australia) may attract an additional shipping surcharge, or may need to ship via standard (non-express) service. We'll contact you if this applies to your order and confirm any extra cost before proceeding — you may cancel for a full refund if you don't wish to proceed.
8.6 If your order's shipping cost needs to be adjusted after you've placed it (due to size, weight, or delivery location), we'll contact you with the revised cost. If you don't wish to pay the difference, we'll cancel and refund your order in full.
Free Express Shipping
Free express shipping is offered for all orders over $250 where the estimated freight cost is $45 or less.
When completing your order at the checkout you will need to enter a valid shipping address. Once added you will have the option to select your preferred shipping option. The 'Free' pricing will be displayed for the applicable options. Please select your option and complete your order.
The Free Express Shipping offer is only available for orders placed through our website and will not be honoured for orders placed with us through other channels.
9. Cancelling an order
9.1 Once an order has been placed online, please contact us as soon as possible if you need to change or cancel it — we can only guarantee a change or cancellation if the order hasn't yet been processed for dispatch.
9.2 For custom, made-to-order, or bulk orders, cancellation after we've accepted the order may incur a fee reflecting costs we've already incurred (for example, with a supplier or manufacturer), up to the full order value.
9.3 Once an order has been dispatched, it cannot be cancelled — the return process in Sections 3–6 applies instead.
10. Important notice for medical equipment
10.1 Mega Medical and our staff are equipment suppliers, not medical practitioners, and we do not provide medical advice, diagnosis, or treatment recommendations. Any equipment purchased should be used strictly in line with the guidance of your prescribing or treating healthcare professional.
10.2 If you have purchased an oxygen concentrator or other therapeutic oxygen equipment, please note this equipment is not a life-support device. Always ensure you have a separate, prescribed backup oxygen source available, and follow your healthcare provider's instructions for correct use.
10.3 By purchasing equipment from us, you confirm it is for use under the guidance of a qualified healthcare professional where relevant, and you agree to indemnify us against claims arising from a failure to seek appropriate medical advice, or from misuse or incorrect settings/operation of the equipment.
11. Liability
11.1 To the extent permitted by law, we exclude liability for indirect or consequential loss arising from your purchase or use of our products.
11.2 Where liability cannot be excluded but can be limited, our liability is limited, at our option, to replacing the goods, supplying equivalent goods, repairing the goods, or refunding the purchase price.
11.3 Nothing in this section limits your rights under the Australian Consumer Law (see Section 13).
12. Retention of title and risk
Ownership of goods remains with Mega Medical until we have received payment in full. Risk in the goods (including responsibility for loss or damage in transit) passes to you on delivery.
13. Your rights under Australian Consumer Law
Nothing in these terms is intended to exclude, restrict, or modify your rights under the Australian Consumer Law. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law, and you may be entitled to a replacement or refund for a major failure, and compensation for other reasonably foreseeable loss or damage, in addition to the remedies described above.
14. Force majeure
We are not liable for any delay or failure to perform our obligations where this is caused by circumstances beyond our reasonable control (for example, natural disasters, carrier disruptions, or supply shortages). Where such an event materially affects our ability to supply your order, we will contact you and may cancel the order with a full refund.
15. Governing law
These terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of its courts.
